Licensing information and agreement

END-USER LICENSE AGREEMENT (EULA)

1. This End User License Agreement (EULA) is a legal agreement between you (either an individual, corporation, public organization or a company whatsoever) and DesignerFreeSolutions for the software product accompanying this EULA, which includes computer software and may include associated media and printed materials, database scripts and schema, as well as on-line or electronic documentation. By installing, copying, or otherwise using the software product, you agree to be bound by the terms of this EULA.
2. You can install, use, access, run, or otherwise interact with 1 COPY of this SOFTWARE PRODUCT. You may however have a localhost, non-productive installation for testing purposes.
3. The software product is licensed, not sold. DesignerFreeSolutions sells the license to use the software product, not the software product itself.
4. DesignerFreeSolutions will offer FREE support and access to free updates of the software product (if and when such updates are published) for 12 months after your order date.
5. You are not allowed to distribute or resell or rent or lease or lend this SOFTWARE PRODUCT or modifications or derivatives or components of it without prior written permission from DesignerFreeSolutions.
6. If you are buying this software as a developer for your clients you may charge them a service fee at your own discretion for configuration and/or installation. You are still bound however by the rest of the terms of this agreement.
7. You may modify the source code of the software product solely for your own use. The modified software product and/or any parts, components or derivatives of it should not be made available for sale, resale or distribution under any circumstances. The modification does not constitute an intellectual property rights transfer neither a copyrights transfer. Both remain under DesignerFreeSolutions.
8. DesignerFreeSolutions will not offer free technical support neither any custom updates for the modified software product.
9. You may permanently transfer all of your rights under this EULA provided you retain no copies, you transfer all of the software product (including all component parts, any upgrades and this EULA), and the recipient agrees to the terms of this EULA. You should notify DesignerFreeSolutions in such an event.
10. The software product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.
11. DesignerFreeSolutions may terminate your rights under this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the software product and all of its component parts.
12. Except as written in this agreement, the software product is provided to you as-is.
13. DesignerFreeSolutions expressly disclaims any warranty for the software product. The software product and any related documentation is provided "as is" without warranty of any kind. DesignerFreeSolutions does not warrant that the functions of the software product will meet your requirements or that operation of the software product will be uninterrupted or error free. The entire risk arising out of use or performance of the software product remains with you.
14. To the maximum extent permitted by applicable law, in no event shall DesignerFreeSolutions or its affiliates or its resellers or its associates be liable for any special, incidental, direct or indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the software product, even if DesignerFreeSolutions has been advised of the possibility of such damages.
15. If you encounter any bugs, DesignerFreeSolutions will provide an update at no charge. Please contact us.
